ECNX Terms and Conditions
These Terms and Conditions (the “Terms”) govern your access to and use of the applications and services provided by ECNX Patient Encounters (“ECNX”, “we”, “us” or “our”). Please read them carefully before using the service.
1. Acceptance of Terms
By creating an account, accessing our website or using any ECNX ™ application, you agree to be bound by these Terms and by our Privacy Policy and Payment Policy. If you do not agree to these Terms, you may not use the service.
2. The Service
ECNX provides the ECNX ™ suite of AI driven patient care applications, including AMBIENT, Encounter, PADX, RoadMap, eDoc and PA. Together these applications connect patients, physicians and urgent care facilities, capture and document care encounters, and guide patients through their personalized wellness road maps.
3. Accounts and Registration
To use most features of the service you must register for an account and provide accurate, complete and current information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at support@ecnx.org if you suspect unauthorized use of your account.
4. Medical Disclaimer
ECNX is a care-delivery support platform. It is NOT a substitute for professional medical advice, diagnosis or treatment. Always seek the advice of a qualified physician or other health provider with any questions you may have regarding a medical condition. If you believe you are experiencing a medical emergency, call your local emergency services immediately — do not rely on the service.
5. Acceptable Use
You agree to use the service only for lawful purposes and in accordance with these Terms. You may not misuse the service, attempt to access accounts or data belonging to others, interfere with the operation or security of the platform, upload malicious code, or use the service to harass, defraud or harm any person.
6. Patient Content and Recordings
Certain ECNX ™ applications capture audio, transcriptions and documents during care sessions. By participating in an encounter you consent to the capture of the session for the purpose of delivering and documenting your care. You retain ownership of your content and grant ECNX a limited license to process it solely to provide the service, as described in our Privacy Policy.
7. Intellectual Property
The service, including the ECNX ™ name and the AMBIENT, Encounter, PADX, RoadMap, eDoc and PA marks, and all software, designs and content provided by us, are the property of ECNX Patient Encounters or its licensors and are protected by trademark, copyright and other intellectual property laws. No rights are granted to you other than the limited right to use the service in accordance with these Terms.
8. Subscriptions and Fees
Some features of the service are provided under paid subscription plans. Billing, renewals, cancellations, refunds and related matters are governed by our Payment Policy, which forms part of these Terms.
9. Termination
You may stop using the service or close your account at any time. We may suspend or terminate your access if you breach these Terms, misuse the service, or where required to protect the service, our users or the public. Upon termination, provisions that by their nature should survive — including intellectual property, disclaimers and limitation of liability — will remain in effect.
10. Disclaimers and Limitation of Liability
The service is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied. To the maximum extent permitted by law, ECNX and its officers, employees and partners will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, revenue or profits, arising from your use of or inability to use the service.
11. Governing Law
These Terms are governed by the laws of the State of Washington, USA, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the service will be brought exclusively in the state or federal courts located in Seattle, Washington.
12. Changes to These Terms
We may revise these Terms from time to time. When we make material changes we will post the updated Terms on this page and, where appropriate, notify you by email or within the application. Your continued use of the service after changes take effect constitutes acceptance of the revised Terms.
